MARTIN, Justice.
On 9 May 1983 defendant Leroy McNeil (defendant) was indicted for the first-degree murders of Deborah Jean Fore (Fore), Elizabeth Faye Stallings (Stallings), and Irene Dina Kearney (Kearney). At the 26 March 1984 Criminal Session of Superior Court, Wake County, Judge Coy E. Brewer granted the State’s motion to join the Fore and Stallings murders but denied the State’s motion to join the Kearney murder. On 9 May 1984 the jury convicted defendant of the first-degree murders of Fore and Stallings on the basis of malice, premeditation and deliberation, and the felony murder rule.…
