*438Shry was indicted and found guilty of killing Leroy W. Merchant, and was sentenced to the penitentiary for a term of years. After his trial and sentence, and while he was in the jail of the county of Loudoun awaiting removal to the penitentiary, Merchant’s administrator brought his action of trespass against him for having wrongfully caused the death of his decedent, and process to answer this suit was served upon Shry.
