Short sued the Galveston, Harrisburg & San Antonio Railway Company, alleging that on June 5, 1912, he purchased from the agent of said company at Uvalde a ticket for passage from that town to Seguin, Tex., and upon the same day boarded defendant’s train, and surrendered his ticket to the servant and agent of the company before the train arrived at San Antonio, Tex., and that it was no fault of plaintiff’s that he was without evidence showing the payment of his fare, and of his being entitled to a continuous passage to Seguin, Tex.; that some time before the train arrived at Marion the…
