MEMORANDUM OPINION AND ORDER

PHILIP PRATT, Chief Judge.

The South Macomb Disposal Authority (Authority) brings this suit against the United States Environmental Protection Agency (EPA) challenging the constitutionality of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), as amended by the Superfund Amendments and Reauthorization Act of 1986 (SARA or 1986 Amendments), codified at 42 U.S.C. § 9601, et seq.
