Petitioner Scott M. Driscoll, M.D., is the defendant and cross-complainant in a civil lawsuit filed in state court. Driscoll filed an amended cross-complaint against plaintiffs Todd Spencer, M.D. Medical Group, Inc., and Todd Spencer, M.D. (hereafter referred to collectively as Spencer or real parties in interest). Driscoll alleged a claim of retaliation in violation of title 31 United States Code section 3730(h), which is part of the federal False Claims Act (FCA) (31 U.S.C. § 3729 et seq.).
