This is an appeal from a final award of the Industrial Board of Indiana made on the 23rd day of January, 1940. The action was originally instituted by Benjamin A. Michaw against L. P. Friestedt Company (erroneously named H. F. Friestedt Company), E. J. Albrecht Company, and the State Highway Commission of Indiana.

The appellee Benjamin A. Michaw was injured on the 4th day of June, 1936. At that time he was in the employment of the L. P. Friestedt Company and was engaged in the construction of a bridge on the state-highway. At the time of the accident L. P. Friestedt Company was operating as a…
