In 1956, George Nawrocki was convicted of uttering and publishing a forged check. In 1967, the Michigan Court of Appeals reversed Nawrocki’s conviction and ordered a new trial. Thereafter, the prosecutor dismissed the charges by entering a nolle prosequi. Nawrocki then brought a civil action against Eberhard Foods, certain of the employees of Eberhard Foods, and the City of Grand Rapids, alleging that he was falsely arrested and imprisoned, resulting in malicious prosecution and denial of his constitutional rights, and other damages incidental thereto.
