A motion is made to dismiss the writ of error upon the ground that no federal question was properly raised in the state court. The disposition of this motion requires a consideration of § 237 of the Judicial Code, which section is in effect but a re-enactment of § 25 of the Judiciary-Act of September 24, 1789, and §709 of the Revised Statutes of the United States.
