Ernesto Gonzalez-Segura v. Jefferson Sessions, III

Court of Appeals for the Fifth Circuit

Decided February 6, 2018No. 16-41413PublishedCited by 6 opinions

1Opinion of the CourtEdward C. Prado, Circuit Judge

Ernesto Gonzalez-Segura was born out of wedlock in Mexico in 1969. His father was a U.S. citizen, and his mother was a Mexican national. Gonzalez-Segura now seeks derivative U.S. citizenship. He believes two documents substantiate his claim: his birth certificate (which a Mexican court revised in 2007) and his father's 1970 holographic will. The district court concluded that he could not as a matter of law prove his derivative citizenship under *129 former Immigration and Nationality Act 1 §§ 301(a)(7), 2 309(a). 3 We AFFIRM the district court's summary judgment against him.
