This suit was instituted oh February 5, 1919, by D. Shelby Williams, a citizen and resident of Davidson county, Tennessee, against James S. Frazer, also a citizen and resident of the same county and State, and the defendant Frazer filed an answer to the complainant's bill on February-18, 1919. Mr. Williams, the original complainant, died after defendant’s answer was filed but before any proof was taken by either party, and the cause was thereafter revived and prosecuted to a final decree in the name of the Fourth and First National Bank, executor of the will of the said Shelby Williams,…
