This is an action by Samuel DeSimone against the Coatesville Area School District (“CASD”) for a violation of 42 U.S.C. § 1983, wrongful discharge, and breach of contract, all in connection with DeSimone’s termination from the position of acting school superintendent. With respect to CASD’s alleged violation of § 1983, the pivotal issue before the court is whether Pennsylvania law, and, in particular, § 10-1080 or § 5-514 of the Public School Code, vests acting superintendents with property rights in them employment.
