The issue presented by this appeal arises from the use of a warrant executed by the appellant authorizing the entry of “judgment . . . for the sum of $16,000.00 . . . debt, besides costs of suit and all expenses for effecting insurance . . .” In the warrant it was also agreed, that “if . . . any part thereof, has to be collected by proceedings at law, then an attorney’s fee of ten per cent should be added to and collected as part of the costs of such proceedings, . . .”.
