Appeal from a judgment of the Supreme Court (Hayden, J.), entered April 14, 2015 in Chemung County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

In 2007, following a trial on the severed first count of a 28-count indictment charging petitioner with robbery in the first degree, petitioner was convicted of that charge and sentenced to a prison term of 20 years to life.
