Appellee began this action in the circuit court of Kankakee county to recover damages for personal injuries sustained by him on the 10th day of April, 1895, at Brazil, Indiana. The declaration contained two counts, to which appellant filed a plea of the g'eneral issue. Trial by jury resulted in a verdict for plaintiff for @5000, on which judgment was entered, and the defendant appealed to the Appellate Court for the Second District. This is an appeal from a judgment of affirmance in that court.
