This case comes before the court en bane upon a petition for revocation of an order granting interpleader. The facts may be briefly stated.

On May 8,1941, plaintiff, Harold M. Leach, brought suit in assumpsit against Mary M. Brothers and Cassie J. Brothers, defendants, to recover a real estate commission of $300, alleged to have been earned by plaintiff under an oral contract of employment for the sale of defendants’ property to E. L. Vincent.
