The petition, in its material portions, reads as follows:

“Your relator says that the city of Fostoria, Ohio, is a municipal corporation under the laws of the state of Ohio; that Fred O. Brumley, John H. Twining, Oscar Slosser, Newton C. Mohler, T. J. Enright, George M. Fink, and W. D. Zuber are the duly elected, qualified and acting members of tbe city council of the said city.
“Your relator further says that there is now, and at all times hereinafter mentioned has been, a duly appointed, qualified and acting board of health of the said city.
