The appellant filed an information in the nature of a quo warranto against the appellee to try the right to the office of superintendent of1 education of Franklin county, which office was claimed by both, the duties of which were being discharged by the appellee. From a judgment dismissing the information the appellant has broug’ht the ease to this court. ,
