Pouza v. State

District Court of Appeal of Florida

Decided March 2, 2005No. 3D04-2271PublishedCited by 1 opinion

1Per curiam

As properly conceded by the State, the trial court erred in denying the appellant’s motion seeking credit for an additional 21 days for time served. See Hidalgo v. State, 729 So.2d 984 (Fla. 3d DCA 1999). Accordingly, we reverse and remand with instructions to the trial court to grant the appellant an additional 21 days credit for time served. See C.C. v. State, 841 So.2d 657 (Fla. 4th DCA 2003).

Reversed and remanded with instructions.
