This is an appeal pursuant to leave granted by this court, from an order of the Appellate Division, First Department, which unanimously affirmed so much of a decree of the Surrogate’s Court, New York County, as construed a remainder to the “ issue ” of the life beneficiary of a trust, to pass to her descendants per stirpes, rather than to her *113descendants per capita. All of the real property situated in New York has been administered by the ancillary trustees under the supervision of the New York Surrogate’s Court.
