This adversary proceeding is based on a complaint for relief from the automatic stay provided for by § 362 of the Bankruptcy Code. On May 1, 1979, the plaintiff, First Connecticut Small Business Invest ment Company (FCSBIC) commenced a state court action to foreclose a mortgage on property owned by the defendant-debt- or, Paul E. Ruark (Ruark), located at 221 Three Mile Hill Road, Middlebury, Connecticut (property), and used as a residence by his wife.
