ELLISON, J.

I join Judge Broaddus in concurring in the opinion written by Judge Johnson holding the statement filed with the justice by the plaintiff was sufficient to confer jurisdiction; and I also concur in his view that the remainder of the discussion therein is not involved in the case. But as I regard the effect of the views expressed by Judge Johnson not in keeping with the understanding of proceedings before justices of the peace heretofore entertained, I will add the following:
