— Appeal from a judgment of the Supreme Court at Special Term, entered December 11, 1979 in Albany County, which denied petitioner’s application, in a proceeding pursuant tó CPLR article 78, to annul the determination of the Comptroller denying petitioner’s application for accidental disability retirement. These proceedings were previously before this court and the pertinent facts are set forth in our decision in Matter of Dolan v Levitt (61 AD2d 1075).
