MEMORANDUM OPINION
ALBRITTON, Chief Judge.
I. INTRODUCTION
This cause is before the court on a Motion to Remand (Doc. # 17), filed by the Plaintiff on August 19, 2003. The Plaintiff, Carrie Fitts, the personal representative of the Estate of Johnny Fitts, who is deceased, originally filed a Complaint in the Circuit Court of Lowndes County, Alabama on June 30, 2003.
