This case was tried to the court without the intervention of a jury, and at the conclusion of the evidence the court rendered a judgment in favor of defendant in error.

It will be seen that the parties appear in this court in the same order which they occupied in the common pleas court.

This suit was instituted in the common pleas court by Paul R. Allen, the. executor of the estate of Henry Hermelin, upon an insurance policy.
