I. INTRODUCTION & BACKGROUND
On December 26, 2009, Tremayne G. Flythe was fatally shot by an officer of the District of Columbia’s Metropolitan Police Department (“MPD”). Mr. Flythe’s mother, Betty S. Flythe, brought this action in her personal capacity and on behalf of the estate of Mr. Flythe against the District of Columbia (“the District”) and the two officers directly involved in the shooting, Officers Travis Eagan and Angel Vazquez.
