MEMORANDUM OPINION

(March 1, 2007)

I. INTRODUCTION

THIS MATTER comes before the Court on the Motion of Plaintiff, Joseph Petrohan [hereinafter “Joseph” or “Plaintiff’].1 Plaintiff moves this Court to find, in limine, that “no proof or evidence of fault shall be relevant and/or admissible” to the division of the marital home. More specifically, he asks the Court to find that no marital homestead, as defined in 33 VI. CODE ANN. § 2305(a) (1962) has ever existed at 72-R Estate Clairmont.
