This appeal is from a judgment of affirmance by the Superior Court of Houston County, reviewing by certiorari the judgment of a justice of the peace in a dispossessory warrant case under Code § 61-301 et seq.

Pete Dlearo made an affidavit before a justice of the peace that Joe Lopez, doing business as Pepe’s Restaurant, was in possession as a tenant at will of described premises; that rent became due on the first of the month and was not paid; and that the tenant failed to vacate the premises after notice.
