WEST, District Judge.
This is an action brought by plaintiff, McKinley Z. Mallitz, against The Bankers Fire and Marine Insurance Company and The Traders and General Insurance Company, seeking damages as a result of an accident which occurred on May 11, 1958. The plaintiff, a pedestrian, was struck by a 1957 Oldsmobile automobile operated by one Eugene Earl Anderson, husband of Altee Anderson. At the time of the accident, Anderson and his wife owned a 1957 Pontiac automobile in addition to the 1957 Oldsmobile involved in this accident.
