The object of this bill, which was filed under How. Stat. § 3049, is to declare forfeited the right of defendant to receive any toll by reason of its failure to rebuild a bridge across Grand river.

The defendant was organized February 24, 1880, for the purpose of constructing a gravel road from the city limits of the city of Grand Rapids, where Plainfield avenue intersects the same, along the State road, commonly called the “Plainfield Road,”, through the township of Grand Rapids, to the bridge called the “Plain-field Bridge,” a distance of seven miles.
