Superfos Investments Limited, t/a Superfos Trading, Inc., brought this action seeking-damages from defendant FirstMiss Fertilizer, Inc. (FirstMiss) for defendant’s alleged breach of its obligations under a contract for the sale and purchase of anhydrous ammonia, a liquid fertilizer. The contract, executed between FirstMiss as buyer and Superfos as seller, was for a term commencing April 1, 1988 and ending December 31, 1990, and required FirstMiss to purchase a minimum of 80,000 tons of anhydrous ammonia in each year of the contract.
