Appeal from an order of the Supreme Court (O’Shea, J.), entered December 4, 2012 in Chemung County, which, among other things, granted defendants’ motion for summary judgment dismissing the complaint.
Ryan Evans called 911 to report that his mother was in a vehicle with an intoxicated individual, Nicholas Cicci. During the course of the call, Cicci threatened to shoot any responding police, which Evans relayed to the 911 operator. Defendant Richard L.
