MEMORANDUM AND ORDER

CON ABO Y, District Judge.

This is an action for damages brought under the Swine Flu Act, formerly codified at 42 U.S.C. § 247b(jM1) (1976), 1 and the Federal Tort Claims Act (hereinafter FTCA), 28 U.S.C. §§ 1346(b), 2671 et seq. Presently before the Court is a motion for summary judgment filed by the Defendant. 2 The basis of this motion is that Plaintiff’s claim for relief is barred by the applicable statute of limitations. For the reasons set forth below, the Defendant’s motion will be granted in part and denied in part.
