The Assistant Vice-Chancellor :

The original bill in this cause was filed by the mother of the present complainant, for a partition of certain real estate, and an account of her share of the rents and profits. The complainant having died, the suit was revived in the name of the present complainant, as heiress at law ; but no letters of administration having been taken out by her, it was not revived as to a claim for rents and profits accrued at the death of her mother.
