Appellant is the owner of the west one-half of the southwest quarter of section 30 in the town of Bosedale, Mahnomen county, upon the south line of which was a slough unfit for cultivation. In 1915 the town board of Bosedale attempted to lay out and establish a public highway on the south line of that section, and, during the fall of 1917, entered into a contract for the grading of a road across such slough.
