The Administrator With the Will Annexed of the Estate of Frederick D. Michael, deceased, brings this suit to have the will of the decedent construed. The will nominated Frederick Michael as executor, but he ivas a nonresident and Martin J. 0 ’Brien, Public Administrator, was appointed Administrator With the Will Annexed. O’Brien died and his successor in office, John F. Cahill, was substituted as plaintiff.
