Before the Court is a motion for summary judgment (Docket No. 149) by Plaintiff Richmond Steel, Inc. (“RSI”) to dismiss the counterclaim of Defendant Legal and General Assurance Society, Ltd. (“LGAS”). RSI, a .construction firm based in Texas, brought this claim for declaratory relief and monetary damages based on diversity jurisdiction 1 .
