The appellee was a passenger upon one of appellant’s cable trains operated upon and over its Milwaukee avenue line, crossing the Desplaines street viaduct. The train consisted of a grip-car and two open trailers. He boarded the rear trailer at Randolph street and Fifth avenue, and took his place upon the foot-board of the car running along its south side, which became the west side of the car when its course was changed northwardly. The seats were all occupied, and the aisles and platform and foot-boards upon both sides of the car, were partly filled by people standing.
