Plaintiffs bring a class action complaint against their long-term disability insurance provider alleging violations of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1001-1461 (1999). Presently before the Court are three motions filed by Defendant: 1) Defendant’s Motion to Dismiss and/or Strike Amended Complaint (Docket # 5); 2) Defendant’s Motion to Dismiss Count II (Docket # 6); and 3) Defendant’s Motion to Sever Plaintiffs’ Claims (Docket # 7).
