This was an action for money. Judgment was for defendant sustaining a demurrer to the petition. Plaintiff appeals.
The petition alleged that plaintiff was a resident of Topeka and that Topeka was a city and had a population of more than 50,000 and less than 90,000. It further alleged that plaintiff became an employee of the city in 1912 and that he continued in such employment until April 12, 1937, at which time he retired on account of being disabled by disease contracted by him while in the performance of his duties as an employee of the…
