{¶ 1} In this case, we are asked to resolve a conflict between the Second and Seventh District Courts of Appeals concerning whether a certified police officer who is appointed chief of police in a township with fewer than 10,000 residents, a police department with fewer than ten officers, and no civil service commission has the automatic right upon termination to return to the position he held before his appointment as chief of police pursuant to R.C. 505.49.
