At the January term, 1859, of the Court of Common Pleas of Madison county, Horace B. Makepeace, as *436the guardian of Cassandra Makepeace, filed his petition for the sale of certain land'belonging to his ward, at private sale. The record of the proceedings shows the appointment of appraisers, and their report, appraising the land at twenty-four hundred dollars. Then follows a’report of the sale, which recites that pursuant to an order of the court, made at that term, the said guardian did, on the 7th day of January, 1859, sell to the appellee the property described, for twenty-five hundred…
