—Judgment, Supreme Court, New York County (William Leibovitz, J.), rendered February 25, 1999, convicting defendant, after a jury trial, of burglary in the third degree, and sentencing him, as a second felony offender, to a term of 3V2 to 7 years, unanimously affirmed.

Defendant’s suppression motion was properly denied. Police responding to a report of a burglary in progress were informed by building employees that a described individual carrying only an empty bag had claimed to be making a delivery to a commercial office on a floor where all the offices were closed for the night, and had also…
