The defendants, Jose Sanchez, Julian Cuevas, Eduardo Hernandez and Jesus Quiles, are charged, acting in concert, with unlawful assembly (Penal Law § 240.10) and violating New York City Parks and Recreation Department Rules (56 RCNY) § 1-05 (a) (1), entitled “Assemblies, meetings, exhibitions.” In separate omnibus motions, the defendants move to dismiss the accusatory instrument against them on the ground of facial insufficiency.
