This case was evidently begun and tried by plaintiff upon the theory that his remedy was under the Employers’ Liability Act (Laws 1911, pp. 16, 18), and the contention of defendant here is that the plaintiff has not brought himself within the provisions of the act, either by pleadings or proof.
