HEANEY, Circuit Judge.

Plaintiff appeals an order entered in this civil rights action by the United States District Court for the Eastern District of Missouri denying his prayer for damages1 and declaratory judgment.

The case was tried below upon stipulated facts. The plaintiff’s minor son, Michael, age eighteen, was shot and killed by defendant Marek, a police officer, while attempting to escape arrest.
