On Feb. 1, 1850, the complainant, Joseph S. Cucullu, was the owner of certain real estate situate in the parish of St. Bernard, in the State of Louisiana, known as the Myrtle Grove Plantation. On the day mentioned he made and delivered to one E. Villavaso his note of .that date for $10,000 borrowed money, due in twelve months, and secured the same by an act of mortgage, dated Feb. 7, 1850, on, said plantation; and on Feb. 4, 1858, he made another note, also for $10,000 borrowed money, du.e in one year, payable to himself, and indorsed and delivered it to the same Villavaso, and secured it by…
