The plaintiff in error, hereinafter referred to as the defendant, was by information filed in the district court- of Le Flore county charged with the crime of robbery with firearms; was tried, convicted, and sentenced to serve a term of 25 years in the state penitentiary, and by case-made with petition in error attached, has appealed to this court.
