Percy B. Sullivan and W. K. Tuttle were jointly indicted in the circuit court of Vermilion county on the charge of obtaining the property and money of John Elliott by means of a confidence game. The charge was dismissed against Tuttle during the trial but Sullivan was found guilty and sentenced to an indeterminate term in the penitentiary. By this writ of error he brings the cause here for review.
