Parties are referred to herein as in the trial court.

On January 6, 1933, Yahdeka Byrd, plaintiff herein, executed a deed of trust in which he named B. A. Marlin, defendant herein, as trustee of the “Yahdeka Byrd Trust”. Marlin was given the general powers of a trustee with respect to all of Byrd’s property; the trust was to expire five years from the date of execution of the deed of trust. Sometime thereafter, and while the trust relationship existed, Byrd made an outright conveyance to Marlin of certain lands involved in this action.
