Before the court were allegations brought by the petitioner, the Commissioner of the Administration for Children’s Services, under article 10 of the Family Court Act that Gabriel A. (hereinafter, the subject child), born May 8, 2001, was abused by Umar A. (hereinafter, the respondent father) and Rachel A. (hereinafter, the respondent mother). The petition was filed on August 22, 2003. An amended petition, filed on September 5, 2003, alleges that the subject child is an abused child in that his brother, Christopher A., age six months, died from fatal…
